DHS Seeks Public Comments on 4th Set of HCBS Setting Evidentiary Packages

December 3, 2019
By Bobbie Guidry

The Minnesota Department of Human Services (DHS) is seeking public comments through Jan. 2, 2020 on evidentiary packages related to the heightened scrutiny process under the Home and Community-Based Settings rule. Adult day, customized living, foster care, and prevocational/structured day services are included in this set of evidentiary packages, including several LeadingAge Minnesota members.

The Centers for Medicare & Medicaid Services (CMS) requires states to submit evidentiary packages for settings that CMS presumes are not home and community-based. Evidentiary packages include information gathered during on-site visits and the provider-attestation process.

The public comment period is a good opportunity for residents, their family members and the broader community to comment on their experiences of living in the setting, and how they experience life as part of a community-based setting, rather than that of an institution.

See the HCBS settings heightened-scrutiny process for more information and links to the evidentiary packages for the providers included in this fourth set.
