LTCC Validation Expected to Resume Under Assisted Living Licensure

By Bobbie Guidry

The requirement for an assisted living licensed setting to inform a prospective resident of the availability of and contact information for long-term care consultation services continues as we transition to assisted living licensure.

Under 144G.70, Subd. 2 (e), a facility must inform the prospective resident of the availability of and contact information for long-term care consultation services under section 256B.0911 before the date on which a prospective resident executes a contract with a facility or the date on which a prospective resident moves in, whichever is earlier. However, the additional requirement for the facility to receive a verification of long-term care counseling provided to the prospective resident by the Senior LinkAge Line has not been updated to have it apply to assisted living licensed facilities.

DHS intends to continue the same requirement of the facility requiring the verification number before executing a contract. Representatives from DHS shared in a meeting last week that language to correct this and other references to housing with services has been submitted to the Revisor's Office. We anticipate that these changes will occur soon, but they will likely not be in place by Aug. 1.
