Minor Change Made to Home Care Law

June 26, 2018
By Bobbie Guidry

While the legislative session did not result in the clarifications to the Home Care Law that we had worked on with the Minnesota Department of Health, the HomeCare Association and the Long-Term Care Imperative, a minor change was made to the law regarding life-sustaining treatment.

The change is in 144A.4791, HOME CARE PROVIDER RESPONSIBILITIES WITH RESPECT TO CLIENTS, Subdivision 13, which covers a request for discontinuation of life-sustaining treatment.

The change allows the Home Care Provider to report such a request to an advanced practice registered nurse, in addition to the physician, and to work with the advanced practice registered nurse, in addition to the client and their physician, to comply with provisions of the Health Care Directive Act in chapter 145C.
