New Assisted Living Bill of Rights Requirement Effective January 2026

An addition to Minnesota’s Assisted Living Bill of Rights was passed in the 2025 legislative session and is effective Jan. 1, 2026. The addition simply ensures the right to have a support person physically present at the times of a resident’s choosing.
New Language
The new language is added to 144G.91 as Subdivision 6a. Effective Jan. 1, 2026, the revised Bill of Rights version must be provided to a new resident before the initiation of services to that resident. Current residents must also be provided with the revised version.
Providers must also acquire a written acknowledgement from the resident/responsible party as stated in 144G.90, Subd. 1(d): “A facility must obtain written acknowledgment from the resident of the resident's receipt of the assisted living bill of rights or shall document why an acknowledgment cannot be obtained. Acknowledgment of receipt shall be retained in the resident's record.”
While the written acknowledgement of receipt is required, the document itself may be delivered electronically to residents/responsible parties. At this time, it is unknown when MDH will post the new version on their website.
